According to the Health Minister regulation No. 28/2011, a clinic is a health service facility which provides basic and/or specialized medical service. It must be led by a medical professional who is helped by more than one health workers. The clinic's organization structure, function, monitoring, and evaluation is stated the regulation. However, its implementation should be assessed at the side of operator, manager, and the society who uses the service. We found that the assessment is needed even though the regulation does not mention the necessity of it. The research aim is to study the variety and pattern of the health service facility/clinic whether they implement an ethicolegal of provider and use relationship. The expected outcomes of this research could be used as a foundation for a legislative consideration in determining further regulation. Hopefully, the regulation could contain guidance on administration and supervision of the clinic with an ethicolegal approach. The research is a collaboration project between Institution of Research and Development Ministry of Health and Indonesian Medical Clinic Association (PKMI) and was conducted in four cities, Surabaya, Bogor, Medan, and Denpasar. Samples were taken with purposive sampling method. Those cities were chosen because of the fact that they are included in AFTA and WTO agreement. The samples of the research are the director and the patients of the clinic. Thirty director and 100 patients are the number of samples involved. The data collection method employed indepth interview with a structured questionnaire. The data were analyzed with quantitative and qualitative method. The research results showed that several clinics did not comply with a number of requirements written in the Ministerial Regulation. Must of the clinics did not inform clearly about type of provided services and the name of the medical professional on their promotion media and board. The research also found that there is no Standard Operating Procedure (SOP) for medical treatment. Furthermore, the patients also were not aware of their rights and obligation during in the service. They do not consider Legal and ethical aspects in choosing the right health service for them. In conclusion, the research found that the regulation tend to be less protective for the patient's safety. Furthermore, there is a chance that the clinic's managers actually did not understand about the regulation. Therefore, an operational procedure for the health minister which is applicable in the field is needed. However, a comprehensive research that assesses the requirements of a good health clinic service should be conducted in the first place.
